Creole Bay Suites and Spa - Conditions of Sale


By booking on our website www.creolebay.fr or on a booking platform, you automatically accept the following general conditions of sale:


The stay is non-modifiable and non-refundable.


COVID 19 INFORMATION:


In the event of a no-show due to government measures related to covid 19 (border closures only), we only offer a postponement of the stay (Credit valid for 12 months).  


Cancellation 30 days or less before arrival is not refundable, 100% of the amount of the stay will be charged. If you cancel before 30 days of arrival, 70% of the amount of the reservation will be charged.


A deposit of € 350 by credit card imprint will be requested upon arrival. This deposit is required to access the apartment. It will be returned to you within a maximum of 7 days after your departure, less any damage or the cost of restoring the premises.

We remind you that parties are strictly prohibited as well as the invitation of third parties.


Failure to comply with this regulation will result in a deduction from the deposit of 250,00€


The payment of your stay will be made as follows:


- 70% of the total amount of the stay will be debited from your reservation.

- 30% of the balance of the stay will be taken less than 30 days before your arrival.

If your check-in does not take place before midnight on the scheduled day of arrival, we are no longer obliged to maintain your reservation and all nights allocated to your reservation will be considered canceled,


We reserve the right to pre-authorize your bank card for an amount equal to the late cancellation penalties specified on your confirmation as soon as the cancellation limit date is exceeded. Pre-authorizing your card does not result in any debit from your bank card. But some banks may present the pre-authorized amount in the 'pending transactions' section since it will be payable upon your arrival (or non-arrival).


A pre-authorization can affect the level of credit available on your bank card insofar as late cancellation penalties are due as soon as the cancellation deadline has passed. As a pre-authorization is not a debit, the day after the scheduled day of arrival, it is canceled and replaced either by your final note invoiced at the time of departure, or by late cancellation penalties. We reserve the right to charge penalties and deny accommodation to individuals whose behavior results in damage or serious consequences to the hotel; or a serious lack of respect and courtesy towards our other customers or employees.


The tenant will enjoy the rental in a peaceful manner and make good use of it, in accordance with the destination of the premises. On departure, the tenant agrees to make the rental as clean as he finds it on arrival.


The reservation will become effective when the tenant has paid the deposit of the rental at least 30 days before his arrival by transfer, credit card, checks (bank, Ancv, etc.). If the tenant delays his arrival, he must notify the owner beforehand. As soon as the customer informs us of his cancellation of stay for various reasons, it is no longer guaranteed and will be canceled automatically: the credit card imprint for the deposit on arrival will be cancelled.


A security deposit must be paid when taking possession of the rented premises and this to respond to the loss or damage that could be caused to objects, furniture or others. It will be returned to the tenant within 7 days after his departure, less any damage or loss of keys or objects and any abuse of electricity consumption.


If the security deposit proves to be insufficient, the lessee undertakes to complete the sum after the exit inventory. This guarantee cannot in any case be considered as a contribution to the rent.


On his departure, the tenant agrees to return the rental as clean as he will have found it on his arrival. If the accommodation is not returned in a perfect state of cleanliness, the tenant will pay for the cleaning of an amount of €50.00.


The establishment is completely non-smoking. Failure to comply with this regulation will result in deodorization costs of €250 deducted from the security deposit.


The cleaning of the room will be carried out obligatorily by the establishment from 6 days of stay.



Any additional people on the reservation will be charged €70.00/person/day.


In the event of a prolonged power or water cut during the stay, the owner will not be required to reimburse the client for the stay or the expenses related to the purchase of food or other basic necessities. The owner will endeavor to resolve the problem as soon as possible, but cannot be held responsible for service interruptions beyond its control. The customer is encouraged to take out travel insurance to cover these eventualities and to take the necessary precautions to deal with such situations.


All the equipment listed in the inventory must be returned to the place it occupied when entering the premises. The lessee undertakes to maintain the sanitary, electrical and heating installations in perfect condition, for which he must take all precautions. Any repairs made necessary by negligence or poor maintenance during the rental will be the responsibility of the lessee. The rental may in no case benefit third parties, except with the prior agreement of the owner.


The loss of a key (room key or portal beep) results in a billing of €40.00/key.


The rental can in no way benefit third parties. If it is found people not appearing in the reservation, the owner can request the eviction of all the tenants: The contract is broken by this fact. The full amount of the rent remaining acquired or due to the owner


The lessee is prohibited from subletting, under any pretext whatsoever, even free of charge, under penalty of termination of the contract. The owner will provide the accommodation as described and will keep it in working order. As a general rule, the tenant will vacate the premises at the time specified in the contract or at a time convenient to the owner, after inventory.


The tenant may not under any circumstances invoke any right or maintenance in the premises at the expiration of the period provided for in this contract, except with the agreement of the owner.   


Cases of force majeure, such as canceled flights, illnesses, hurricanes, and other unforeseen events in no way affect the non-modifiability and non-refundability of the stay.

Consequently, the establishment cannot under any circumstances be held responsible for these cases of force majeure beyond its control and bears no responsibility for losses, additional costs or inconveniences resulting from these unforeseen events.

 The tenant is invited to use their additional insurance, such as travel insurance and/or their bank card, to cover losses or costs associated with these force majeure events.


Le Créole Bay – Suites et Spa declines all responsibility in the event of falls, bodily injury or material damage, loss, theft or alteration of material goods throughout the establishment as well as the garden and outdoor areas.


Customers have 7 days from the date of departure to collect a found item. After this period, and without news from the customer, the item will be considered abandoned and will be destroyed.

The decorative elements for the “special romantic or honeymoon decoration” services are the property of Créole Bay. Any missing items will be deducted from the deposit of €350.00


Photo shoots for commercial or private purposes must be the subject of a request to the owner who will establish a contract in which the specific conditions appear.


Le Créole Bay - Suites and Spa is a classified tourist accommodation and does not offer the services of a classic hotel (daily cleaning, breakfast included, 24-hour reception).


JACCUZI SPACE AND GARDEN


Any discoloration of the water in the jacuzzi caused by a swimsuit and any found objects in / and around the jacuzzi (rose petals, cigarette butt, plugs, foams) will result in a deduction of € 200.00 from the deposit. The outdoor space must not be polluted with various waste. Objects left in the hot tub can seriously damage the operation of the appliance.


INTERNAL RULES


1 Shower beforehand with soapy water, long hair tied back recommended.

2 Access and use of this relaxation area is strictly reserved for the owners and tenants of the residence. Any deviation from this rule can only be done by express agreement of the owners. Access is prohibited for children under 16, and children under 18 unaccompanied by an adult.

3 The Well-being Space is based on rest and relaxation. We ask you to respect the required calm and discretion.

4 The owners of the residence reserve the right to exclude and prohibit entry to the wellness area to any person whose behavior violates these rules

5 It is not recommended to bathe with any valuables.


Non-compliant swimsuits, sunscreens, objects, decorations, oils and foods are strictly prohibited.

6 Beware of drowning: the heat enhances the effects of drugs and alcohol and can cause unconsciousness. Get out immediately if you feel tired or drowsy. The practice of SPA is not without consequences for health according to individuals.

7 You use it under your responsibility: in the event of damage to the equipment or use of soap in the SPA, repairs of the damage will be the responsibility of the users


We invite users to be cautious and to find out about this practice from their doctor. During pregnancy, the use of SPA can harm the unborn child. If you have health concerns (cardiovascular problems, diabetes, obesity, etc.) seek advice before using the SPA. In case of skin lesions, avoid using the SPA.
